Article 1: General conditions of sale

The offer and sale of products on our website www.family3-0.com are governed by these general conditions of sale.

The general conditions of sale may be modified, particularly in consideration of possible regulatory changes. The new general conditions of sale will apply from the date of their publication on www.family3-0.com.

Article 2: Validity of the order

The contract is deemed to be concluded at the time when www.family3-0.com receives, electronically, confirmation of the order, once the accuracy of the data relating to the order has been verified.

Before proceeding with the purchase of the products, by confirming your order, you are asked to carefully read these general conditions of sale.

By electronically transmitting the order confirmation, you unconditionally accept and undertake to comply with these general terms and conditions of sale in your dealings with www.family3-0.com.

If you do not agree with the terms stated in these general conditions of sale, we invite you not to transfer your order form for the purchase of products on www.family3-0.com.

By sending your order confirmation, you confirm that you know and accept these general terms and conditions of sale without reservation.

Article 3: Validation

The data recorded by www.family3-0.com during the validation of commercial sales constitutes proof of all transactions carried out by www.family3-0.com and its customers.

The data recorded by the payment system constitutes proof of financial transactions.

Article 4: Availability

Our product offerings are subject to availability.

Make sure your contact information is correct: name, address and telephone number.

When ordering, check item by item that the number, color, size and price are correctly reflected in your order form.

When a product is no longer available, it is displayed as "Sold Out" and it is no longer possible to order it.

Our teams work every day to avoid any inventory errors. However, errors can occur. We will therefore be forced to cancel your order. You will be notified by email.

Article 5: Price

The prices of our products are indicated in Euros, all taxes included.

If you are ordering from a country other than mainland France, you are the importer of the product(s) concerned.

For all products shipped outside the European Union and French overseas territories, the price will be automatically calculated excluding taxes on the invoice. Customs duties, local taxes, import duties and state taxes may be required. These duties and amounts are not the responsibility of www.family3-0.com. They are your responsibility and are your sole responsibility both in terms of declaration and payment to the competent authorities and organizations in your country.

www.family3-0.com reserves the right to modify prices at any time, but products will be invoiced based on the prices in effect at the time orders are placed, subject to availability.

Article 6: Payment

All orders shipped to France and the EU are expressed in Euros, all taxes included, with the VAT rates in force in France.

Additional information may be requested to secure your payment.

We offer payment by credit card through our partners Shopify and Payplug, PayPal, Apple Pay, and also payment in several installments through our partner Klarna.

Article 7: Delivery and returns

www.family3-0.com offers several delivery options. In France, UPS deliveries take 48 to 72 hours, and are free for purchases over €250 (€350 in Europe). International express deliveries via DHL are also available. Delivery times vary depending on the destination.

For deliveries to a collection point, if the package is returned to us because it was not collected on time by the customer, the order will be treated as a customer return and you will be refunded (excluding delivery costs). If you wish to have the package returned to you, you will be asked to pay the shipping costs again.

For returns, you have 14 days from receipt of the order to return the items. After this period, any returns will be refused.

To request a return, it is mandatory to complete the process on our online return portal.

Returns are the customer's responsibility. The customer is responsible for returning the product(s) in the same condition as received, with all labels and other documents in a secure and sturdy package.

Damaged or incomplete products are not accepted (missing label, damaged or already worn item, damaged packaging... non-exhaustive list). Following the refusal of your return our team will contact you and you will have a period of 2 months to arrange the return of your item at your expense.

Returns related to non-payment of customs duties or import taxes:

In the event of refusal or failure to pay customs duties, import taxes or fees required by local authorities upon delivery, and if the package is returned to www.family3-0.com, the fees charged to the sender (including return shipping costs and unpaid customs duties) will be automatically deducted from the refund amount due to the customer.

Reimbursement, if applicable, will only be made after receipt of the package by our logistics department and verification of its condition.

Article 8: Security

Our website uses a security system. We have adopted the SSL decryption process and have also strengthened all scrambling and encryption processes to protect all sensitive data related to payment methods as effectively as possible.

Article 9: Intellectual property

All texts, comments, works, illustrations and images reproduced on the site www.family3-0.com are reserved under copyright and intellectual property law throughout the world.

As such, in accordance with the provisions of the Intellectual Property Code, only use for private purposes is tolerated subject to different or more restrictive provisions of the Intellectual Property Code. Any other use constitutes infringement and is punishable under intellectual property law unless prior authorization is obtained from www.family3-0.com.

Article 10: Applicable law - Disputes

This contract is signed in French and is subject to French law. In the event of a legal dispute, only the French courts will have jurisdiction.

Article 12: Liability

The products offered comply with current French legislation. It is your responsibility to check with the local authorities in your country regarding the possibilities of importing or using the products or services you plan to order.

The photographs and texts reproduced, illustrating the products presented are not contractual. Consequently, www.family3-0.com cannot be held responsible for any errors in photography or text.

www.family3-0.com cannot be held responsible for non-performance of the contract concluded in the event of stock shortage, unavailability of the product, in the event of force majeure, disruption, flooding, fire or strike, in particular of postal services and means of transport or communication.
